TOWN OF SANTA CLARA BOARD MEETINGS
Minutes of a Regular Monthly Meeting of the Santa Clara Town Board held on Thursday
November 12, 2009 at the Saranac Inn, NY Town Hall at 7:00pm.

Meeting was called to order by Suprv. Webb. Motion by Thomas Kimpton seconded by Thomas Chipperfield
to dispense with the reading of the minutes of the previous meeting. All members voting Aye.
Motion carried.
Motion by Thomas Kimpton seconded by Thomas Chipperfield to accept the minutes of the previous meeting. All members voting Aye. Motion carried.
Co. Chipperfield was asked to read proposed Local Law No. 2,of 2009. This local law shall be
known as "The Town of Santa Clara Aquatic Invasive Species Prevention Law." The purpose of the
law is to prevent the introduction and spread of aquatic invasive species into and within The
waters of the Town of Santa Clara, and to thereby protect aquatic native species populations
biodiversity and aquatic recreational activities for the public good.
Definitions:
For the purposes of this local law, the following terms shall have the following meanings:
- 1. "Aquatic animals" shall mean an animal that spends part of its life in water, including,
but not limited to, freshwater, estuarine and wetland species.
- 2. "Aquatic plants", shall mean plants living in the water or at the shoreline, and include
roots, rhizomes, stems, leaves or seeds, including freshwater esturarine and wetland species.
- 3. "Boater" shall mean the operator of the boat or towing vehicle.
- 4. "Invasive Species" shall mean any species listed by the NYSDEC as being invasive to the
waters of NYS, such species include, but not limited to, Eurasian milfoil, variable leaf milfoil,
water chestnut, curly leaf pondweed, Brazilian waterweed, zebra mussels and round goby.
- 5. "Standing water" shall mean bilge water and other water inside boat compartments that
could easily be removed by pump or hand.
- 6. "Water body" shall mean any freshwater or estuarine lake, river, pond, stream or wetland
existing in the state, wheterh publicly or privately owned, including the banks and shores thereof.
Prohibited Acts:
No watercraft or trailer shall enter or exit a water body of the Town unless the boater removes
all aquatic plants and or animals from inside and outside of his/her vehicle, watercraft, trailer
or any other equipment that had previously come into contact with any wate body. The boater
must also remove any standing water that is visible to the unaided eye from the boat and trailer
before he/she enters a water body. Removed items must be discarded away from the shoreline.
Exceptions:
- 1. Those persons with a permit to do such activities.
- 2. Those persons who have legally purchased bail or harvested fish.
- 3. Those persons who have legally taken waterfowl.
Penalty for noncompliance:
Any person who violates this local law is gulty of a criminal ciolation, punishable with
a maximum fine of Two hundred fifty dollars.
Administration and Enforcement:
Section 1. Complaints:
Any person may file a complaint with any state, county or local law enforcement officer
having jurisdiction that a violation of this law may have taken place.
Section 2. Enforcement:
This law may be enforced by the Franklin County Sheriff's Department or any other law
enforcement officer having jurisdiction.
Article E, Enactment:
This local law shall become effective upon its being filed with the NYS Department of State
Following the reading of the proposed Local Law, a motion was made by Marcel Webb seconded
by Thomas Chipperfield directing the clerk to prepare a notice of Public Hearing on the Proposed
Local Law No. 2 to be held on Thursday, December 10, 2009, Saranac Inn, NY, Town Hall at 6:45PM.
Copies of the proposed Local Law will be available and the Public Hearing notice will appear in
the Adirondack Daily Enterprise. All members voting Aye. Motion was carried.
Mr. Dalheim asked if the law would be enforceable and the Supervisor said copies of the adopted
Local Law would be mailed to all law enforcement agencies and signs would be posted at
launch sites that the Town has adopted a stop invasive species local law.
A grant request costing $3,200.00 has been submitted but there has been no response yet.
The County Highway Dept. will assist with the installation fo the Floodwood bridge, so it will not be
necessary to go out to bid. The project will get underway in the spring. The Supervisor has
received letters from Forestcraft and a request from Landvest. They had designated five parcels
of the former Champion Paper land for possible development of sale and the Supervisor feels that
legal guidance is needed and will contact Miller & Mannix
The Adirondack Park Agency has asked for the opinions and ideas that would being about regulatory
reform. Opinions and priorities were requested relating to principles for revision
of the APA Act, Local Government Issues, Environmental Advocacy Issues, General Public Issues
and APA Act Administrative issues. The Supervisor requested each Board member review the request
and submit response to him before he makes any reply.
No date has been set for the joint meeting of the Planning Board and the town Board, relating
to the Town Land Use Code.
Code Enforcement Officer's monthly report was presented to the Board for review.
Supervisor Webb contacted Mr. Sonneborn and he said the final payment to Judge Sheren would
be forthcoming, according to his attorney. Mr. Sonneborn said in the other matter, he hoped
for a summary judgement within 30 to 90 days. Miller & Mannix will handle Mr. Day's case against
the Variance Board's decision.
The successful bidder on the grader has been asked to help on the Kesse Mills bridge but he
will pick up the grader as soon as he can. Sayles Construction will start on the roof work and
Overhead Door has replaced one door and repaired doors at the District #1 building.
Budget Amendment offered by Thomas Chipperfield seconded by David Perry to transfer $100.00 from
Account 1990.4, Contingency, to A5010.4, Supt. of Highways and to transfer $8,673.00 from DA5142.1
, Snow Removal PS to DA5110.1, General Repair PS. vote as follows: Thomas Chipperfield - Aye,
David Perry - Aye, Marcel Webb - Aye, Philip Durkin - Aye, Thomas Kimpton - Aye. REsolution adopted
by unanimous vote.
General Fund vouchers No. 242 to 268, in the amount of $15,282.42 and Highway Fund
vouchers No. 101 to 111, in the amount of $20,025.89 were audited by the Board. Motion by Thomas
Chipperfield seconded by Thomas Kimpton to pay these bills, All members voting Aye. Motion
carried
Motion to adjourn at 8:00PM made by David Perry seconded by Philip Durkin. All members voting
Aye. Motion carried.
