TOWN OF SANTA CLARA BOARD MEETINGS

Minutes of a regular meeting of the Santa Clara Town Board held on Thursday May 14th 2009 Saranac Inn, NY Town Hall at 7:00pm.

Roll call as follows:

Meeting was called to order by Supvr. Webb. Motion by Marcel Webb, seconded by Philip Durkin to dispense with the reading of the minutes of the previous meeting. All members voted Aye. Motion carried.

Motion by Phillip Durkin, seconded by Thomas Kimpton to accept the minutes. All members voted Aye. Motion carried.

Jim Crane, USLA gave an update on the fireworks display to be held on July 4th, 2009 at 9:30pm. On Tommy's Rock or a barge nearby.

If the event is to be canceled a decision will be made by 1:00pm and USLA will do a blast email and a recorded message will be available at 891-1871. If there are weather problems the event will be rescheduled. Mr. Crane will contact Nina Schoch by the end of May to survey the area for loon nests and report findings to Rick Mincher (pres. Of USLA) who will decide what to do about the loons.

$445 has been received in contributions to date.

Mr. Crane talked to Patrick Duprey about providing a barge for the event at a cost of $1000. Plus transportation permit fee. if it is not being used on a job. The barge is 14X32 and is acceptable to Alonzo. The barge will require docking for the night. The fireboat will be available and would like help with lighting afterwards to get racks loaded on the pontoon boat. The event will be publicized in the May 2009 USLA Newsletter and posted on five bulletin boards. Alonzo will need POC provided by Mr. Crane(not sure how long).They don't require anyone to stay with them but would like a way to get their man with the fireworks off the island if there is thunder and lightning in the area. Some help will be needed with parking at the State launch site. Possibilities were Franklin County Sheriff or NYS Police. Supt. McGill suggested contacting the Fire Police to assist with security and parking. The event will begin with Kate Smith's ÒWhen The Moon Comes Over The MountainÓ and conclude with ÒGod Bless AmericaÓ. Co. Chipperfield asked what if there is a loon nest and Mr. Crane said he will have an update by the June 11th meeting.

Legislator Paul Maroun was supposed to attend the meeting but was unavailable.

The Planning Board met two weeks ago and will have two more meetings and then provide the Board with their recommendations.

Co. Kimpton attended a meeting with the Fire Advisory Board.

Outdoor Wood Boiler regulations have been completed. Ron Otten has put a lot of research and effort into preparing these regulations. It is fairly conservative depending on whether you are constructing in a populated area where more stringent regulation is needed or if there is no one around you. If the landowner has a problem he/she can apply for a variance. Supvr. Webb will take the regulations to James Maher, Atty. for review. Motion by Thomas Chipperfield seconded by David Perry to schedule a public hearing on outdoor wood boiler regulations as soon as Atty. Maher completes his review of the regulations. All members voting Aye. Motion carried. Mr. Otten was thanked for his dedication in preparing the regulations. Co. Chipperfield presented Franklin County with a copy of our land use plan for their time capsule and the County sent a Certificate of Appreciation to the Town. Co. Chipperfield was thanked for acting as the Town's representative.

The Code Enforcement Officer's Report was received. Co. Perry asked about setbacks for Lean-tos. And the supvr. said they were the 75' from the water the same as other buildings.

An outside appraiser will be hired to review a property that is being contested. The Brown Cottages were to receive a letter from the State but to date have receive nothing. Se. trying to get the Legislature to allow the Town of Tupper Lake to take over the Tupper Lake Fire Dept. without forming a fire district. Michelle Garcia asked when Camp Cherokee was going to remove the building but no permit has been requested. Jin Crane reminded everyone to vote on the school budget. Ron Otten tried to report two stray dogs go the Humane Society but received no answer. The Supervisor said they are dependent on volunteers and usually you can leave a message on their answering machine.

Suprv. Webb said North Country Chapter is asking for a donation of $150 which includes a leadership program. They were going to include additional information about this organization but it had been omitted. The matter was discussed and Co. Perry said to request the information that was omitted. The request will be tabled until the next meeting.

Supvr. Webb received a letter from Pam Martin, Variance Board Chairman, tendering her resignation after many enjoyable years on Sept. 30, 2009. Her resignation was accepted with deep regret for she has done an outstanding job. Motion by Marcel Webb, seconded by Phillip Durkin to make a presentation acknowledging her generous contribution, in September. All members voting Aye. Motion carried.

A rental check in the amount of $2600 has been received from Time Warner Cable. The $200,000 check from Mr. Beneke is being held by Byron Varin, Franklin County Treasurer, until he receives an order from the judge. The town will receive $192,000 plus 9% interest. Co. Perry sais the number fro the Tri Lakes Humane Society will be placed on the web site. He said that effective Jan 1, 2009 an operator of a PWC, operating alone, must be 14 years old and have successfully completed a boating safety course.

Supt. McGill said the town should receive $45,443.33 plus the balance from 2008 of $4,635.44 from CHIPS. It will cost $38,000.38 to pave 1/2 mile of Bay Pond Road. The log trucks have broken up the pavement and he wants the project completed by June 1, before the price of paving material increases. East Pine Pond beaver dam flooded the Floodwood Road. DEC took care of the beaver and NYSDOT had to remove the beaver dam under the railroad tracks. No word on the placing of the dry hydrants. Four portable radios to be used when flagging can be purchased at a cost of $932 each. Motion by Tom Kimpton seconded by Phillip Durkin to purchase radios. All members voting Aye. Motion carried.

General fund vouchers No. 101-130 in the amount of $6681.83 and Highway Fund Vouchers No. 38-49 in the amount of $276.08 were audited by the Board. Motion by Thomas Kimpton seconded by Tom Chipperfield to pay the vouchers. All members voting Aye. Motion carried.

Motion by Phillip Durkin seconded by Thomas Chipperfield to adjourn the regular meeting for a brief executive session to discuss a personnel matter. All members voting Aye. Motion carried.

Supvr. Webb asked all members to think about a replacement for Pam Martin.

Motion by David Perry seconded by Phillip Durkin to adjourn the meeting at 9:00 pm. All members voting Aye. Motion carries.
