TOWN OF SANTA CLARA BOARD MEETINGS

Minutes of a regular monthly meeting of the Santa Clara Town Board held on Thursday April 16, 2009 at the Saranac Inn, NY Town Hall at 7:00pm.

Roll call as follows:

Meeting was called to order by Supvr. Webb. Motion to dispense with the reading of the minutes of the previous meeting made by Marcel Webb, seconded by Philip Durkin. All members voting Aye. Motion carried.

Motion by Philip Durkin seconded by David Perry to accept the minutes of the previous meeting. All members voting Aye. Motion carried.

Suprv. Webb made a motion seconded by Philip Durkin to recognize two of our residents, Margaret and James Dalheim on their 60th wedding anniversary, a very special occasion. All members voting Aye. Motion carried.

Suprv. Webb said John Schaff, Chairman of our Planning Board, is not present this evening but word has been received from Franklin County Legislature that they are considering the formation of a Franklin County Planning Board. The Supervisor has some reservations about projected costs. The extra tax expense would not benefit our Town. Co. Durkin is not in favor of a County Planning Board as it would tend to service the larger communities rather than towns of our size. Co. Perry said the type of service being considered doesn't fit our needs. Suprv. Webb said we will have the expense in our taxes but the northern part of the County will be the ones to benefit. Suprv. Webb will respond that our Town is not in favor of the formation of a County Planning Board.

Mr. Beneke's lates appeal was heard two weeks ago and the case was dismissed. Atty. Sonneborn was told to go back to Judge Demarest and ask that he add legal fees paid by the town in the amount of $200,000.00 plus 9% interst, payable to the Town immediately and do not appear in appeals court again. All of his assets will be reviewed to see if additional funds can be levied.

In the Yanchitis dispute over the Town road, the judge hasn't awarded the property to the town but it is moving to a conclusion.

Camp Cherokee has sent applications for a building permit. They have a site location in place and hope to have the structure moved. They will have to seek a variance sot he Variance Committee will have to decide about a height variance.

Outdoor Wood Boiler regulations are underway, no grand-fathering in state regulations. The Upper Saranac Assoc had another location for the fireworks display, but it was unacceptable to a lady loon expert. She will check for loon nests in June near Tommy's Rock, to be sure no loon's will be distressed by the display. Jim Crane will ask NYSDEC about using the launch ramp for the display. Co. Kimpton will ask Chris Early about using his barge.

The Code Enforcement Officer submitted reports for two months, which were reviewed by the Board. A thank you letter has been received from Mary Jane Connors, CEO of Life Flight Training for the Assessment Board of Review members will be held on Wednesday, May 6, 2009 at the Kitchen Conference Room at the Court House in Malone from 1:00PM to 4:00PM. The supervisor said beginning in 2010, installment payments will be accepted for tax payments, a minimum payment of $100.00. The County shall provide the software, training and maintenance for all municipalities. Many communities are applying for stimulus funds, should our Town ask for funding for a salt shed, Suprv. Webb said most of the funds have been allocated to projects which have been proposed but not started because of a lack of funding. NYS has reinstated the full amount of CHIPS funding for 2009-2010. Co. Perry said there will be no regulations for the operation of jet skis. He said if anyone has something for the website, bring it to the Board's attention. Suprv. Webb said Camp Gabriels will be closing July 1, 2009. he said letters will be sent to exempt property owners requesting some consideration in lieu of taxes. He said the Saranac Lake Village Manager will be holding a meeting with the contacting communities to ask for more money for fire and rescue services. We will listen to the discussion and then negotiate. Supt. McGill was asked to get estimates for needed roof repair at the District #2 Town Building. It as noted that the dry hydrants were never installed, the Supervisor will contact Tupper Lake and ask them to continue with the project. A man who used to paint signs for NYSDEC will be contacted about a new sign for the District #2 town Building. Michelle Garcia asked when the new flag pole would be installed. The clerk was supposed to bring a source book and forgot it.

Supt. McGill said they are cleaning roads of winter debris. He said the grader is running but has to gradually resume full power. He said the quarries may have to shut down because DEC wants their tanks to be off the ground to permit a complete inspection. Salt contracts will permit Franklin and Clinton Counties to buy salt in bulk, at a rate of $71.00 a ton. He said the Bay Pond Rd. has been badly broken up by the log trucks.

Abstract #3 General Fund vouchers No 68 to 77, in the amount of $4,204.72 and Highway Fund vouchers No. 20 to 28, in the amount of $4,309.99 were audited by the Board. Abstract No. 4 General Fund vouchers No. 78 to 100 in the amount of $9, 360.18 and Highway Fund vouchers No. 29 to 40in the amount of $3,642.47 were audited by the Board. Motion to pay these bills made by Thomas Kimpton seconded by Philip Durkin. All members voting Aye. Motion carried.
